The Rules seem to pertain to 'redundant, immaterial, impertinent, or scandalous matter.' However, I used such motions on several occasions where claims were brought against my clients personally, though their actions had occurred in their corporate roles. Rule 1.150 and most Judges require such motions to be verified. A sample motion is set forth below:<br />

Once a complaint has been filed, it is highly likely the Defense will file a motion to dismiss. Motions to Dismiss essentially test whether the pleadings (complaint) are legally sufficient, and set forth a recognized cause of action in accordance with the Court Rules. Most of the Rules governing a Motion to Dismiss are set forth by Fla.R.Civ.P. 1.140(b). However, in a nutshell, the most common reasons a motion to dismiss are filed are the following:<br />
<br />
1) The Plaintiff has failed to attach necessary documents, i.e. the contract they are suing on, in violation of Fla.R.Civ.P. 1.130. (Hence the complaint fails to state a cause of action).<br />
2) The Plaintiff has failed to state a cause of action, i.e. each cause of action has a number of required elements and the Plaintiff has failed to plead one or more of them.<br />
3) The Plaintiff alleges in his complaint allegations at odds with, and contradicted by, the documents he attaches. <br />
4) The Court lacks jurisdiction over the person or subject matter. <br />
5) Less commonly, motions to dismiss are filed based on lack of prosecution, improper service, failure to join a necessary party.<br />
<br />
Generally, when the Court grants a motion to dismiss, the Plaintiff is given several further opportunities to amend their complaint, so the primary benefit of filing one is largely tactical.<br />

As noted on the Application for Credit, SCOTT LASTNAME is not an

the claim to his insurance carrier, Mid-Continent Casualty Company, as
indicated by Defendant’s Exhibit “<b>2</b>”. <o:p></o:p></span></div>

<span style="font-size: 12.0pt; line-height: 200%;">8. Ultimately, Mid-Continent Casualty Company denied
coverage. Subsequently, Defendant
CLAYTON SURNAME retained Michael B. Lesage, Esq. to defend this action.<o:p></o:p></span></div>

<span style="font-size: 12.0pt; line-height: 200%;">9. The facts alleged in CLAYTON SURNAME’S response, as well as
his proposed Amended Answer, indicate the presence of a real case or
controversy and illustrate that Defendant may assert a meritorious defense in
this action, such that the action should be tried on the merits. <u>Country Clubs of Sarasota, Ltd. v. Zaun
Equipment, Inc.</u>, 350 So.2d 539 (</span><st1:state><st1:place><span style="font-size: 12.0pt; line-height: 200%;">Fla.</span></st1:place></st1:state><span style="font-size: 12.0pt; line-height: 200%;"> 1<sup>st</sup> DCA 1977).<o:p></o:p></span></div>

is satisfied.</div>

4. Plaintiff requests that this Court
retain jurisdiction to enter further Orders that are proper to compel the
Judgment debtor to complete form 1.977, including all required attachments, and
serve it on the judgment creditor’s attorney,.</div>

the proposed amendment is necessary to determine completely the rights of the
parties in this action, to determine the scope of discovery, and to afford the
Plaintiffs complete relief for their injuries.

a defendant may be held liable for punitive damages where the defendant engaged
in gross negligence. Gross negligence in
turn is defined as conduct so reckless or wanting in care that it constituted
conscious disregard or indifference to the life, safety or rights of persons
exposed to such conduct. Sec. 768.72 </span><st1:state><st1:place><span style="font-size: 12.0pt; line-height: 200%;">Florida</span></st1:place></st1:state><span style="font-size: 12.0pt; line-height: 200%;"> Statutes.<o:p></o:p></span></div>

<span style="font-size: 12.0pt; line-height: 200%;"> 4. Regarding a corporate defendant,
punitive damages may only be imposed for the conduct of an employee or agent if
the employer participated in such conduct, knowingly condoned, ratified or
consented to the conduct, or engaged in conduct that constituted gross

striking and disabling a handful of other vehicles, and which resulted in

or “<b>safety plan</b>, though he did have a copy of the applicable FMCSA

regulations, the record evidence in this case will show that Defendant GOLDEN
MULCH CO., INC.:<o:p></o:p></span></div>

<span style="font-size: 12pt; line-height: 200%;">a) knew that safety was important and that
its vehicles needed to be adequately maintained;
<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; margin-left: 1.0in; text-indent: -.5in;">
<span style="font-size: 12pt; line-height: 200%;">a) but acquired used transport trucks
(that together with a trailer could weigh up to 80,000 lbs), in unknown
condition;<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; margin-left: 1.0in; text-indent: -.5in;">
<span style="font-size: 12pt; line-height: 200%;">b) made no attempt to determine the
condition of the trucks at that time, (other than relying on its DRIVERs to do
a pre-trip inspection, for which they had received no company training, and in
any event, were not able to perform correctly;<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; margin-left: 1.0in; text-indent: -.5in;">
<span style="font-size: 12pt; line-height: 200%;">c) left numerous maintenance issues
unaddressed, for a period of approximately two years, (as for some, the shops
wanted to “pull the pan off,” and charge you about $300.00, GOLDEN depo. pg.
107, lines 7-9);<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; margin-left: 1.0in; text-indent: -.5in;">
<span style="font-size: 12pt; line-height: 200%;">d) “maintained” those same trucks in
house, with untrained and/or unqualified personnel, for which no records were
kept;<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; margin-left: 1.0in; text-indent: -.5in;">
<span style="font-size: 12pt; line-height: 200%;">e) had no safety plans, policies or
procedures, to ensure things such mundane things as whether the brakes were
working, whether the steering is working, whether the tires are worn out,
whether the company DRIVERs are taking drugs, fit to drive, safe DRIVERs, etc.<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; text-indent: .5in;">
<span style="font-size: 12pt; line-height: 200%;">9. The evidence in this case will also
show that Defendant GOLDEN MULCH CO., INC. failed to comply with the Federal
Motor Carrier Safety Administration Regulations, <i>see </i>49 CFR § 392.7, Equipment, inspection and use, 49 CFR § 392.8,
Emergency equipment, inspection and use, 49 CFR § 396.7, Unsafe operations
forbidden, 49 CFR § 396.11, DRIVER vehicle inspection reports, 49 CFR § 396.13 DRIVER
inspection. <o:p></o:p></span></div>

critical, and that he was required to follow the FMCSA regulations, though he

<span style="font-size: 12pt; line-height: 200%;">10. Based on the foregoing, Plaintiffs would
argue that the evidence proffered demonstrated that Defendants engaged in
conduct so reckless or wanting in care so as to constitute conscious disregard
or indifference to the life or safety of anyone exposed to such conduct, in
this case, anyone else traveling upon the public roads. <o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; text-indent: .5in;">
<span style="font-size: 12pt; line-height: 200%;">11. Note also that a proffer is merely a
representation of what evidence the plaintiff proposed to present and is not
actual evidence. A</span><span style="font-size: 12.0pt; line-height: 200%;"> reasonable showing by evidence in
the record would typically include depositions, interrogatories, and requests
for admissions that have been filed with the court. Hence, an evidentiary hearing where witnesses
testify and evidence is offered and scrutinized under the pertinent evidentiary
rules, as in a trial, is neither contemplated nor mandated by the statute in
order to determine whether a reasonable basis has been established to plead
punitive damages. <u>Estate of Despain
v. Avante Group, Inc.</u>, 900 So.2d 637, 642 (</span><st1:state><st1:place><span style="font-size: 12.0pt; line-height: 200%;">Fla.</span></st1:place></st1:state><span style="font-size: 12.0pt; line-height: 200%;"> 5<sup>th</sup> DCA 2005), <i>internal citations omitted</i>. Note also that in analyzing a proffer, the
trial court is not called upon to evaluate and weigh testimony and

whether a complaint states a cause of action.
The record evidence is viewed in the light most favorable to the moving

plaintiff was allowed to submit its claim for punitive damages to the jury,
where the defendant was inadequately staffed, and numerous records necessary
for care were incomplete or lost, such that it was proper to allow
amendment. That case should be
controlling here (where the Defendant was also inadequately staffed, and
maintenance records necessary for routine repair and upkeep were not kept).<o:p></o:p></span></div>
<div class="MsoNormal" style="line-height: 200%; mso-layout-grid-align: auto; text-autospace: ideograph-numeric ideograph-other; text-indent: .5in;">
<span style="font-size: 12pt; line-height: 200%;">14. Accordingly, as there is record evidence
that Defendants engaged in gross negligence, and where Defendants knew or
should have known that conduct presented a grave risk to the life, safety or
rights of persons exposed to such conduct, the issue of punitive damage is
proper for submission to the jury, pursuant to F.S.A. 768.72(2)(a).<o:p></o:p></span></div>

A cause of action is a legal theory under which recovery is sought. Some of the more common ones are negligence and breach of contract, fraud and replevin (I want my stuff back). Many have evolved over the last 1000 years from Judge made law, though some have been created by the legislatures. Below, I have posted a link to a guide I've used, the Wites & Kapetan Florida Litigation Guide which contains a much more detailed list. (I have no ownership or affiliation with Wites & Kapetan, I have simply used their guide myself in my litigation practice).</div>

Basically, you can think of the legal system as a French restaurant, only serving certain things. If you want to eat there (or get legal relief), you have to order something on the menu. Causes of action are generally speaking, the only things for which the Courts will provide relief. So, whatever happened, it must be squeezed into one of the existing legal theories.</div>

The First Step in commencing a lawsuit is filing a complaint. In most instances, a complaint is filed in Florida State Court. If the amount in controversy is less than $5,000.00, it is filed in small claims court. If the amount in controversy is between $5,000.00 and $15,000.00 it gets filed in county court, and if its over $15,000.00 it gets filed in circuit court (all limits subject to change). Occasionally, if you're suing someone from a different State for more than $75,000.00 or under a Federal Statute, it gets filed in Federal Court.<br />
<br />
A well written complaint has the following parts:<br />
<br />
1. The Name of the Court<br />
2. The Case Caption - naming the Plaintiff(s) and Defendant(s).<br />
3. The word "Complaint" and a run on sentence listing the names of all Plaintiffs suing all Defendants.<br />
4. The legal reason why the Court has jurisdiction, i.e. see amounts above.<br />
5. The legal reason why suit is proper in the area (venue). Generally, you must sue a Defendant where they live or where the incident occurred.<br />
6. The names and legal capacities of the parties, i.e. adult individuals, minor or disabled individuals, corporations.<br />
7. The first cause of action against the Defendant.<br />
8. At the end of the first cause of action, a Wherefore clause, setting out the relief requested.<br />
9. Any other causes of action. <br />
10. At the end of a complaint, your name, address and phone number (signature block).<br />
11. If your claim arises because of a piece of paper or contract, attach a copy if you have one (Fla.R.Civ.P. 1.130).<br />

(Remember you'll also need to file a civil cover sheet that you get from the Court, and have a summons issued to get your lawsuit going). Trailblazer, with VIN # B. Both vehicles were originally titled between
Plaintiff JAMES DOE and STEVE DOWRONGER, as either co-tenants or joint tenants.<o:p></o:p></span></div>

So you think you have a lawsuit? Typically, civil lawsuits (for money) have 2 elements, liability and damages. Liability really means responsibility, is the other party legally responsible for your damages? If I fall off a bridge (by myself) and get seriously hurt, no one is likely responsible but me. If I get bumped by someone else and then fall off the bridge, that person is likely to be held responsible. In most cases, a lawyer will be the best person to tell you if you have a case, as the law is very convoluted and poorly organized. Generally speaking, for there to be liability, the incident must fall into a recognized cause of action (more on that in later sections).</div>

Damages in turn means 'what have I lost as a result of the incident, transaction etc.' So, if I throw a baseball through your front window, I'm likely going to be responsible for the costs of replacing the window. I'm not likely to be responsible (for any meaningful sum of money) if that annoyed you, hurt your feelings etc. Conversely, if I call you a nasty name or otherwise hurt your feelings, it is unlikely there are any damages, though some exceptions are likely possible due to the tort of intentional infliction of emotional distress.</div>

Finally, if your case is one where you have to pay a lawyer, how much will it cost to litigate, and how much is the lawyer likely going to be able to recover? The legal system works well in collecting from insurance companies and large corporations, but very poorly against individuals (i.e. former Florida resident O.J. Simpson).</div>
